Los crímenes de odio se caracterizan por obedecer a sinrazones que solo existen en la subjetividad del individuo que los perpetra, generalmente desde una postura de superioridad moral, contra víctimas con características que éste mismo atribuye. Estos delitos son arquetipos de esa clase de delitos cuya ofensa supera el daño producido por el acto, caracterizados comúnmente por altos grados de violencia, ensañamiento o brutalidad en su ejecución.

This document presents the full contribution of the Santa Marta Center to the 2025 thematic report of the United Nations Independent Expert on protection against violence and discrimination based on sexual orientation and gender identity (SOGI). Drawing from testimonies, expert interviews, and institutional monitoring conducted between 2024 and 2025, the report analyzes how systemic discrimination, censorship, and institutional neglect impact SOGI-diverse students in El Salvador’s educational system. It addresses the right to be free from discrimination in schools, access to information and comprehensive sexuality education, protection against bullying and violence, access to health services, the right to privacy, the right to identity, and the challenges linked to the lack of disaggregated data. The report provides grounded evidence of structural exclusion and calls for urgent reforms to fulfill international human rights obligations.
